Rider waiver

By attending and participating in this ride, you accept and agree to the following in its entirety:

1. That cycling can be a dangerous activity, especially in traffic, around pedestrians and other cyclists, and that you are at risk and may suffer or cause injury or death or property loss or damage;
2. That you will take care to avoid injury or damage to yourself and others;
3. That you fully assume all risks associated with the ride, known and unknown, and all responsibility for any losses, costs and damages you may incur as a result of your ride;
4. To waive, to the extent permitted by law, any claims, right or cause of action that you, personally, and/or any child in your care, and/or the heirs, executors and administrators of you and each child in your care, may have in contract and civil wrongs law for any personal injury, damage or loss arising from the ride;
5. That the ride is unsupported and that you will be totally self-sufficient;
6. That you will wear a bicycle helmet (compliant with the current required Australian Standard) securely fitted and fastened, in good condition and proper working order;
7. That you will obey all road rules, including use of bike lights when necessary;
8. That you have reviewed, assessed, and accept the information provided about the ride by The Organisers (including the ride map, sign-up form, and any additional information provided);
9. That you are qualified, in good health, have sufficient fitness and skill, and are in proper physical and mental condition to participate in the ride;
10. That your bike is suitable for the ride you are taking part in and that your bike and related components are in good repair;
11. That The Organisers do not hold or provide any insurance protection for accident, sickness or negligence of any participant. Any accident or injury caused by any participant's actions, to themselves or others, will be the full responsibility of that participant;
12. That The Organisers do not hold or provide any insurance protection for any property loss or damage suffered or caused by any participant, any of which will therefore be the full responsibility of that participant;
13. That you agree that you are responsible for any fees or costs incurred or arising from an accident either involving or caused by you. This includes, but is not limited to, fees from police, fire, ambulance or any similar service. If the situation arises that you are not capable of making the decision to call the emergency services, or fail to do so for any reason, you agree that any person may call for you. In this situation, you still accept the costs and consequences of such action;
14. That any monetary donations collected by The Organisers will be used exclusively for upgrading sound systems, cargo bike purchase/hire/repair/upgrades, and operational costs (free stickers and hire costs), and does not constitute an assumption of liability for any aspect of the ride by The Organisers;
15. That this release from liability operates in contract law in favour of The Organisers. This release operates whether or not the damage is due to any act or neglect of any of the beneficiaries of the release;
16. That these terms and conditions are to be governed by the laws of NSW, and the Courts of NSW shall therefore have exclusive jurisdiction to govern the entire agreement between you and The Organisers;
17. If any part or provision of these terms and conditions is determined by a Court to be invalid or unenforceable, all other parts and provisions shall still be given full legal force and effect.

The name, phone number, or email will be kept private and contact will only ever be made for legal reasons.

I acknowledge that I have read this assumption of risk. I fully understand its terms and that I have given up substantial rights by agreeing to it. I accept this document freely and voluntarily without any inducement made to me, and intend my submission of this form to be a complete and unconditional release of all liability to the greatest extent allowed by law.
